BevMo class action settlement

Beverages & More Inc. (d/b/a BevMo) has agreed to settle a class action lawsuit alleging it made misleading statements about its 5 Cent Sale, causing customers to believe they were receiving a larger discount than they actually received. If you bought wine at BevMo's 5 Cent Sale between Oct. 21, 2005 and Feb. 9, 2010, you may be eligible for benefits from the class action settlement.

BevMo occasionally holds a 5 Cent Sale wine promotion in California that provides discounts to members of its ClubBev rewards program. During the BevMo 5 Cent Sale, ClubBev members can buy one bottle of wine and receive a second bottle for just 5 cents.

The BevMo class action lawsuit alleges the beverage retailer violated California law by making misleading statements to California consumers about the 5 Cent Sale, leading them to believe that they were getting a bigger discount than they were, in fact, receiving. BevMo denies any wrongdoing but has agreed to settle the class action lawsuit to avoid the expense, risk and inconvenience of trial. In addition to providing benefits to Class Members, BevMo has also agreed to make certain changes to its advertising regarding the 5 Cent Sale.

Under the terms of the BevMo class action settlement, Class Members will receive an email containing a discount coupon for each purchase of a two-bottle set of wine made during a 5 Cent Sale during the Class Period. NOTE: If you believe your email address is not up to date in BevMo's database, you may update your contact information by either logging into your ClubBev account or by calling BevMo's customer service number. Class Members must update their email addresses no later than July 27, 2015 at 6:59 PST to be eligible for benefits.

Who's Eligible

Class Members of the BevMo 5 Cent Sale settlement include anyone who, between Oct. 9, 2005 and Feb. 9, 2010, purchased one or more two-bottle sets of wine at Beverages & More during a 5 Cent Sale, either at a California BevMo store or through BevMo's website (online purchase must have been made with a California billing address).

Potential Award

If the BevMo class action settlement receives final approval, Class Members will receive a $1 discount coupon for each two-bottle set of wine purchased during a 5 Cent Sale during the Class Period.

These discount coupons can be redeemed in store for a discount on any goods sold by BevMo for up to 180 days after they are issued.

N/A. Eligible Class Members will automatically receive an email containing discount coupons. If you believe your email address is not up to date in BevMo's database, you may update your information online or by calling BevMo's customer service number.
